A 17-year-old male has been arrested and charged on Sunday night after he forcefully had sex with a 16-year-old girl against her will.
According to a probable cause affidavit, the victim told officers on Sunday night she had been sexually assaulted by a friend of hers, 17-year-old Luis Elvis Armendariz.
She told police that after a night of drinking, she and Armendariz were given a ride to his residence, the report explained. After entering the residence and going to his room, the victim said Armendariz made sexual advances toward her and she told him to stop but refused.
Armendariz at that point removed her pants and engaged in sexual intercourse with her against her will, the victim told police. According to the report, she told Armendariz to stop during intercourse, but he refused to listen to her and continued.
Officers spoke with Armendariz, the affidavit said, who told officers he and the victim were given a ride to his residence, and upon making entry to the residence, they went to sleep.
Armendariz also said that after they slept a while, they woke up and had sex, the document stated. He added that he had drunk too much alcohol the previous night and couldn’t remember if the victim told him to stop, nor could he remember if it was against her will.
Officers charged Armendariz with sexual assault of a child, which is a second-degree felony.
Jail records show Armendariz was taken to the Ector County Detention Center on Monday and has a $50,000 bond.
